What is Probate? When someone dies and they normally have property, beneficiaries, and many times creditors. Debts have to be settled. Property has to be gathered. Beneficiaries need to receive their inheritances. Probate is a legal process to make all of this happen.
A petition is made with the Superior Court to name a personal representative (or executor). This is the person who is responsible for the administration of the deceased’s property.
If a loved one has passed away it can be a very difficult and stressful time. Dealing with a legal probate can add to that stress if you do not have the assistance of an experienced attorney. Many of the steps of a probate are as follows:
- Giving notice to beneficiaries and all interested parties;
- Selling of assets (if necessary);
- Distributing assets
- Filing federal estate and state inheritance tax returns
- Open probates in other states if necessary to sell or transfer title to real property.
- Negotiate with creditors and seek to reduce the debt owed by the estate.
If you are responsible for taking care of the will for a loved one, you want an attorney who has experience, that is efficient and affordable.
The last thing you want is to have problems with your family because the probate was mishandled. Also, you may be experiencing pressure from some of the beneficiaries to do things that worry you. You do not want to do anything that could get yourself into trouble. You want peace of mind. Life is already too full and busy for most people to devote themselves to learning to practice law.
